The Ministry of Business, Innovation and Employment (MBIE) has confirmed that its Labour Inspectorate carried out a major compliance operation in Whangārei, targeting local hospitality and retail businesses.

29 Businesses Visited

Inspectors visited 29 businesses over two days as part of Operation Orzo, a nationwide initiative focused on ensuring that employers meet New Zealand’s minimum employment standards.

The operation included cafes, bars, pubs, and restaurants across Whangārei. Inspectors also interviewed around 100 workers to better understand their working conditions.

Part of a Wider National Campaign

Operation Orzo started earlier this year in the Bay of Islands, where more than 50 workplaces were inspected in towns such as Kerikeri, Paihia, Russell, and nearby suburbs like Haruru, Ōpua, and Waipapa.

According to David Milne, MBIE’s Compliance Manager for the Northern Region, the main goal is to “increase visibility and engagement of the Inspectorate” and make sure all employers are following the law.

Key Employment Laws Checked

Inspectors focused on compliance with:

  • Employment Relations Act 2000
  • Holidays Act 2003
  • Minimum Wage Act 1983
  • Wages Protection Act 1983

Immigration Issues Found

The Immigration team joined the operation to check visa compliance. They found that three employers had hired migrant workers without valid visas and would receive infringement notices. One individual was issued a Deportation Liability Notice for breaching visa conditions.

Focus on Education and Fairness

Mr Milne said inspectors are also helping businesses understand their rights and responsibilities.

“Education is an important part of what we do,” he said. “Where breaches are minor or unintentional, our inspectors work with employers and employees to fix the problem.”

However, when clear breaches are found, enforcement action will be taken.

More Operations Ahead

Operation Orzo is one of several compliance campaigns the Labour Inspectorate is running across New Zealand this year. Other sectors under review include transport, construction, horticulture, dairy, and security.

The data collected from the Whangārei visits is still being assessed, and MBIE says it’s too early to confirm how many breaches may have occurred.
